Spies and Secrecy

Updated: June 9, 2021

Barrister and Former ACT Attorney General, Bernard Collaery and his client Witness K, a former Australian spy are currently being prosecuted for alleged breaches of the Intelligence Services Act 2001. Witness K is a whistleblower who revealed information about Australia's bugging of the East Timor's Government during the period where commercial negotiations were underway relating to the oil and gas resources in the Timor Sea.

In this case, there will be no open judicial procedure, the case will be held in secrecy under the direction of the former Attorney General, Christian Porter.

The case raises a number of issues about the rule of law, the court system in Australia, the legality of spying on the East Timor's Government and the role the Attorney General's in the matter.
